Seller Terms

1. About these terms

These terms govern seller accounts, paid listing plans and domain advertising services supplied through Next Big Domain. The service is operated by Clementine Deny, a sole trader trading as Next Big Domain (“Next Big Domain”, “we”, “us” or “our”). Our contact details appear at the end of these terms.

By creating a seller account or purchasing a plan, you agree to these terms. If you act for a business or another person, you confirm that you have authority to bind them.

2. What Next Big Domain provides

Next Big Domain provides advertising and portfolio tools for domain owners. Depending on your plan, these may include a marketplace listing, a dedicated landing page, AI-assisted branding or wording, ownership verification, enquiries and performance statistics.

We are not the seller, owner, broker, escrow provider or registrar for domains listed by third parties. Unless we expressly state otherwise, domain purchases take place through the seller’s chosen registrar or marketplace and are governed by that provider’s terms.

3. Seller accounts

You must provide accurate, current information and keep your login details secure. You are responsible for activity carried out through your account. Tell us promptly if you believe your account has been accessed without permission.

You must be at least 18 and legally able to enter into a contract. We may refuse or close accounts created using false information or used in breach of these terms.

4. Domain ownership and verification

You may submit only domains that you own or are expressly authorised to control and advertise. We may require DNS verification, redirect verification, registrar evidence or another reasonable ownership check before publication and periodically afterwards.

Verification shows that a seller demonstrated control at a particular time. It is not a guarantee of title, freedom from disputes or legal entitlement to use a name. We may suspend a listing if verification expires, ownership changes or a credible dispute is raised.

5. Listing rules

You must provide accurate prices, purchase links and descriptions. You must promptly update or remove a domain that is sold, expires, changes ownership or is no longer available on the stated terms.

You must not list domains that are stolen, fraudulent, unlawfully registered, deliberately misleading, used for unlawful activity, or submitted mainly to exploit another party’s trade mark, identity or reputation. You remain responsible for obtaining legal advice about your domain and listing.

We may edit formatting, reject, pause or remove listings to protect users, comply with law, maintain marketplace quality or investigate a complaint.

6. AI-assisted content

AI tools may create logos, descriptions, use cases, tags, recommendations and promotional material. A verified listing may be published automatically after automated checks. You must review the published result promptly and pause it or tell us if anything is inaccurate, unsuitable or potentially infringes rights. You remain responsible for the accuracy and legality of information you supply.

AI-assisted content and recommendations do not guarantee search-engine rankings, enquiries, traffic, buyer interest or a sale.

7. Plans, prices, credits and renewals

The pricing page shows the current price, billing frequency, listing allowance, included AI credits and main features of each plan before checkout. Subscription plans renew automatically monthly or yearly until cancelled. A single-listing plan lasts for the stated fixed period and does not automatically renew unless the checkout page clearly says otherwise.

Included AI credits are usage allowances for tools such as campaign generation and portfolio advice. They reset at the start of a new paid billing period and unused included credits do not roll over. Purchased credit packs remain available while the account is open, have no cash value and cannot be transferred. A failed generation should return the credit automatically.

Payments are processed by Stripe. We do not store complete card details. You authorise Stripe to charge the payment method supplied for the initial price and each renewal that falls due.

We may change prices for future billing periods by giving reasonable advance notice. If you do not accept a change, you may cancel before it takes effect.

8. Cancellation and refunds

You may cancel a subscription through Plan and Billing in your seller dashboard or by emailing clementine@nextbigdomain.com. Cancellation stops future renewals. Unless a refund applies, access continues until the end of the paid billing period. Listings are then paused rather than deleted, and saved campaigns, research, analytics and enquiries remain connected to the account.

If you purchase as a consumer, you may cancel within 14 days of entering the contract and receive a refund. We currently apply this 14-day refund period even if setup work has begun. This does not affect any other statutory rights you may have.

After 14 days, fees already paid are normally non-refundable unless the service is faulty, not supplied with reasonable care and skill, or a refund is required by law. Contact us if you believe this applies.

9. Failed payments

If a renewal fails, we may provide the grace period shown in the marketplace settings or payment notices. Listings may be paused when that period ends. You remain responsible for charges that became due before cancellation.

10. Enquiries and domain transactions

We may pass buyer enquiries to the relevant seller or make them available through the seller dashboard. We do not guarantee that an enquirer is genuine, funded or legally able to complete a purchase. Sellers must carry out their own checks and use appropriate payment or escrow arrangements.

Any domain sale is a separate agreement between the seller and buyer or the relevant external marketplace. Next Big Domain is not responsible for negotiations, transfer, payment, tax, escrow, chargebacks or disputes arising from that transaction.

11. Statistics

Views, clicks, traffic sources and similar statistics are estimates. Bot filtering, browser settings, caching and technical limits may affect them. Statistics must not be treated as audited figures or evidence of buyer intent.

12. Intellectual property

You retain ownership of your domain and material you supply. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize, adapt and display that material as reasonably necessary to operate and promote your listing and the marketplace.

We retain rights in the Next Big Domain website, software, design and original platform content. You may use downloadable promotional material generated for your listing, subject to any third-party rights and these terms.

13. Availability and changes

We aim to provide a reliable service but do not guarantee uninterrupted availability. Maintenance, security incidents, hosting failures or third-party services may cause disruption. We may change features where reasonably necessary, while avoiding material reductions to a paid plan without notice.

14. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights.

Subject to that, we are not liable for loss caused by a domain transaction between third parties, loss of a domain, an inaccurate seller statement, external websites, search rankings, expected sales, or indirect or consequential business loss. If you buy wholly for business purposes, our total liability relating to a paid plan will not exceed the fees you paid for that plan during the 12 months before the event giving rise to the claim.

15. Suspension and termination

We may suspend or terminate an account or listing for non-payment, expired verification, a serious or repeated breach, suspected fraud, security risk, legal complaint or conduct likely to harm users or the marketplace. Where appropriate, we will explain the reason and allow a reasonable opportunity to respond.

You may stop using the service at any time. Account closure does not automatically refund fees or cancel sums already due.

16. Privacy

Our Privacy Policy explains how we use personal information. By using the service, you acknowledge that information may be processed as described there.

17. Changes to these terms

We may update these terms for legal, security or service reasons. Material changes affecting an active paid plan will be notified reasonably in advance where practicable. The date at the top shows the latest revision.

18. Governing law

These terms are governed by the law of England and Wales. If you are a consumer, you retain any mandatory right to bring proceedings in the courts applicable to where you live. Business users agree that the courts of England and Wales have exclusive jurisdiction.
